Due to changes in federal privacy protection laws relative to the Fair Credit Reporting Act (FCRA) and the Drivers Privacy Protection Act (DPPA), we can no longer provide Motor Vehicle Reports (MVRs) to our clients. In the past, CCA was able to provide this information to assist our clients in the review of current or prospective employee driving records. These changes in the law restrict our ability to provide MVRs to any third parties. Violation of the new statutes can result in severe fines and penalties.
In this new legal environment, insurance companies order MVRs for underwriting purposes only. They advise us of the name of any drivers not meeting their underwriting standards. They cannot share specific MVR information with our staff.
As an employer, you may order MVRs for your employees or prospective employees, with their written consent, to use in making employment decisions when driving records are relevant to the job. You may wish to consult legal counsel about the handling of MVRs and the information therein in this more restrictive legal and regulatory environment.
You can obtain MVR request forms directly from the Department of Motor Vehicles in North Carolina and the Department of Public Safety in South Carolina.
